By Marc Elias · Democracy Docket founder

I have been litigating voting rights cases for over 30 years. I have argued before the Supreme Court, represented presidential campaigns and started my own law firm. With all of my experience as a practicing attorney, I really thought I had seen it all.

That is, until the Department of Justice lost 26 straight cases in a row — all arguing the same thing.

The DOJ’s losing streak started last year, when the Department sued 30 states and the District of Columbia for access to unredacted voter rolls. This attack was a critical part of Donald Trump’s effort to subvert this fall’s midterm elections.

Yet in case after case, in state after state, the Department failed. Judges of all stripes — from Biden appointees to Bush appointees to Trump appointees — shut the DOJ’s argument down.

Recently, the DOJ faced its most damaging blow yet when a federal judge struck down the administration’s effort to demand unredacted voter rolls. Judge Sparkle Sooknanan found the DOJ exceeded its statutory authority and violated federal law, invalidating the policy nationwide.

That means the DOJ is barred from demanding unredacted state voter registration lists, checking those lists against inaccurate federal databases and urging states to remove alleged noncitizens from voter rolls.

When this ruling came down, the Democracy Docket team sprang into action — just as the team did for all 26 voter roll decisions. In fact, Democracy Docket has been covering this story from the very beginning.

Meanwhile, as I have written extensively about these cases, my law firm is litigating many of them.

I have published countless podcast episodes explaining in depth why these cases are so important. It’s not just about the fact that the DOJ is losing and we are winning. These voter roll cases were critical to Trump’s ploy to undermine the midterm elections and control who can vote — and we beat him at every turn.

But this fight is far from over. We are still waiting to hear from Delaware and Utah, and Hawaii and Idaho are stayed pending the 9th Circuit Court of Appeals decision. I suspect this issue will likely land before the Supreme Court in the coming weeks.

When that happens, we’ll be the first to let you know.

That’s because I founded Democracy Docket for times just like this. When I write to you about the DOJ voter roll cases, I’m not speaking as a commentator. I’m writing to you as someone who knows these cases inside and out.

I’m staying up late to record a video, taking time between reviewing legal briefs to write to you, because I believe that we are facing the greatest threat to our democracy we’ve ever seen.

As a Democracy Docket subscriber, you’ve followed the DOJ’s losing streak case by case. As a premium member, you’ll also get my personal analysis: what each ruling means for free and fair elections, and where the fight goes next.

Premium memberships also keep our Democracy Docket’s website, social media and podcasts free for everyone.

If now is not the time, I understand and thank you for still staying in this fight with me. It means more than you know.

Trump’s voter roll scheme was about one thing: making it harder for you to vote and easier for him to cheat. In courtroom after courtroom, judges stopped him. But he isn’t done, and neither are we.

I created Democracy Docket for moments like this, and I’m grateful to face it with you.

The midterms are coming. Stand with us. For $10 a month, you’ll power our mission and get extra content and invitations to virtual events.
